This month, the South Carolina Court of Appeals issued a series of unpublished opinions that apply the state’s various error preservation rules:

  • if a issue is raised but not ruled on, the party must make a Rule 59 motion to request a ruling. McCallum v. Eadon. Op. No. 2013-UP-029 (S.C. Ct.App. filed Jan. 16, 2013).
  • the issue may not be raised for the first time in a motion to reconsider. Charleston Pool and Spa v. Moran, Op. No. 2013-UP-040 (S.C. Ct.App. filed Jan. 23, 2013).
